1. Acceptance of Terms
Welcome to BuildPulse ("BuildPulse," "we," "our," or "us"), a product of BuildPulse Construction Inc., a company based in Richmond Hill, Ontario, Canada.
These Terms & Conditions (the "Terms") govern your access to and use of the BuildPulse website, mobile application, AI estimation services, renovation visualization tools, contractor marketplace, and all related services (collectively, the "Services").
By accessing, browsing, creating an account, or otherwise using the Services, you agree to be legally bound by these Terms and by our Privacy Policy, AI Disclaimer, Cookie Policy, Refund Policy, and Contractor Marketplace Terms, each of which is incorporated into these Terms by reference. If you do not agree, you must not access or use the Services.
You represent and warrant that you are at least eighteen (18) years of age and have the legal capacity to enter into a binding agreement under the laws of your jurisdiction.
2. Description of Services
BuildPulse is an AI-powered software platform that helps homeowners plan renovation projects across Canada and the United States. Services may include:
- AI-generated renovation cost estimates
- AI-generated renovation visualizations and multiple design concepts
- Material recommendations
- Budget planning and ROI projections
- Project timeline estimates
- Contractor matching and quote comparison tools
BuildPulse is a software platform only. BuildPulse is not a licensed contractor, architect, engineer, interior designer, construction company, insurance provider, or financial advisor, and no part of the Services should be construed as such.
3. Account Registration & Eligibility
To access certain features, you may be required to create an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us promptly of any unauthorized use of your account.
4. AI-Generated Content Disclaimer
AI-generated outputs — including cost estimates, visualizations, design concepts, and ROI projections — are provided for informational and planning purposes only. They are generated using statistical models and generalized regional data, may contain inaccuracies or omissions, and do not replace professional engineering, architectural, legal, insurance, financial, or construction advice. 5. Cost Estimate Disclaimer
All cost estimates generated through the Services are preliminary and non-binding. Actual project costs depend on labor, materials, permits, site conditions, contractor pricing, and local regulations. You should always obtain a written quotation from a qualified, licensed contractor before beginning any physical work or committing funds.
6. Contractor Marketplace
BuildPulse may connect you with independent, third-party contractors through its marketplace feature. Contractors listed through BuildPulse are not employees, agents, or subcontractors of BuildPulse. BuildPulse does not guarantee the licensing, insurance coverage, workmanship, pricing, or availability of any contractor, and users are solely responsible for conducting their own due diligence before engaging a contractor. 7. User Content
You may upload photos, floor plans, or other materials ("User Content") to use certain AI visualization features. You retain ownership of your User Content, but you grant BuildPulse a limited, non-exclusive, royalty-free, worldwide license to host, process, reproduce, and display your User Content solely as necessary to provide and improve the Services. You represent that you have the right to upload any User Content you submit and that it does not infringe any third party's rights.
8. Intellectual Property
All software, text, graphics, branding, user interface designs, and underlying proprietary AI models used within the Services are the property of BuildPulse Construction Inc. and are protected by Canadian, U.S., and international intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, sell, or lease any part of the Services. Further detail is available in our Copyright & DMCA Policy.
9. Payments & Refunds
Fees for paid features are disclosed to you before purchase. Except where prohibited by applicable law, all purchases are final and non-refundable, as digital AI services are considered consumed once delivered. Nothing in these Terms limits any mandatory consumer rights available to you under applicable Canadian or U.S. law. Full detail is available in our Refund Policy.
10. Prohibited Conduct
- Use the Services for any unlawful purpose or in violation of these Terms;
- Reverse-engineer, decompile, or attempt to extract the source code or underlying models of the Services;
- Upload content that is unlawful, infringing, defamatory, or that you do not have the right to share;
- Interfere with or disrupt the integrity or performance of the Services;
- Use automated means (bots, scrapers) to access the Services without our prior written consent.
11. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT, EXCEPT WHERE SUCH DISCLAIMERS ARE PROHIBITED BY APPLICABLE LAW.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BUILDPULSE CONSTRUCTION INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES, INCLUDING RELIANCE ON ANY AI-GENERATED OUTPUT OR ENGAGEMENT WITH ANY CONTRACTOR. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO BUILDPULSE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. NOTHING IN THESE TERMS LIMITS ANY LIABILITY THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.
13. Indemnification
You agree to indemnify and hold harmless BuildPulse Construction Inc. and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Services, your User Content, your violation of these Terms, or your engagement with any contractor introduced through the Services.
14. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms. You may stop using the Services and close your account at any time. Sections of these Terms that by their nature should survive termination (including Sections 8, 9, 11–13, and 16) will continue to apply.
15. Governing Law & Dispute Resolution
These Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law principles. Where Services are provided to U.S. users, applicable U.S. federal and state consumer protection laws may also apply. Any dispute arising out of these Terms shall first be addressed through good-faith negotiation; if unresolved, the parties submit to the exclusive jurisdiction of the courts located in Ontario, Canada, except where mandatory consumer protection law requires otherwise.
16. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice through the Services or by other reasonable means. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
17. Miscellaneous
- Severability: If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force.
- Entire Agreement: These Terms, together with the incorporated policies referenced in Section 1, constitute the entire agreement between you and BuildPulse regarding the Services.
- Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
- Force Majeure: We are not liable for delays or failures caused by events beyond our reasonable control.
